California 'Amazon tax' kicks in and local businesses could be ...

Amazon.com - California is the seventh state that passed the new law on affiliate marketing. The law forces affiliate marketing firms with Californian customers to pay the taxes for the commerce.

Governor Jerry Brown (D) signed the law, dubbed as the Amazon tax, on Wednesday and the law took effect on Friday. Amazon tax was raised in the hope to gain estimated annual tax revenue of $317 million.

Before California, there were six states that has signed the law, namely New York, Illinois, Arkansas, Connecticut, North Carolina and Rhode Island. At least ten other states also want to have similar law.

Amazon.com already kicked of its Californian affiliates and other companies are expected to do the same soon. In a letter sent to abandoned affiliates, Amazon said that the law is counterproductive and unconstitutional. It already sued the state of New York upon the similar law.

Critics refers to the 1992 US Supreme Court ruling that holds sales taxes are not to be imposed upon sellers who do not own physical presence in the state.

However, the state California state that if the referrer is located in California and it is successful in driving potential online customers to Amazon.com or other online retailers, than the referrer will have to pay taxes if the sale is more than $10,000 or total sales are as much as $500,000 for all of Californian sales.

Meanwhile, proponents of the law said that that the law will help small business from being crushed more by the online retailers. Currently, local Californian small business is used as a channel to inspect the products while the actual purchase is made through the online retailer.
